una persona moral y otra f\u00edsica demandaron a una Sociedad de Responsabilidad Limitada de Capital Variable (S.R.L. de C.V.). Se destaca en la rescisi\u00f3n por incumplimiento de un contrato de suministro y el pedido de una indemnizaci\u00f3n por da\u00f1os y perjuicios.\u00a0<\/p><p>La parte demandada recombin\u00f3 la declaraci\u00f3n judicial de validez de algunas cl\u00e1usulas. Es inconstitucional cualquier cl\u00e1usula que atente contra la igualdad entre las partes, como aquellas que permitan la rescisi\u00f3n unilateral o impongan condiciones desfavorables.\u00a0<\/p><p>Su justificaci\u00f3n se basa en que el art\u00edculo 78 del C\u00f3digo de comercio respalda la libertad contractual, pero el legislador impone l\u00edmites para garantizar la equidad y el cumplimiento cabal de los contratos. La restricci\u00f3n al principio de libertad contractual, en este caso, busca asegurar que las partes act\u00faen en igualdad de condiciones, observando las leyes y el orden p\u00fablico.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
